Contractural clause

The Contracting Parties shall ensure, that regarding the personal data to which they are controllers, they will provide sufficient guarantees to implement appropriate technical and organizational measures in such a manner that processing meets the requirements of the Regulation (EU) 2016/679 (“GDPR”) and applicable laws and ensure the protection and enforceability of the rights of the data subjects. The Contracting Parties undertake to ensure that data subjects, such as contact persons stated in the order and persons acting on behalf of the Contracting Parties, whose personal data are supplied to other Contracting Party, shall be provided with the Privacy notice under Art. 14 of the GDPR (“Notice PD”).

Order is the Agreement referred to by the Notice PD; and
Seller is the controller referred to by Notice PD.
